If you were not able to take Field sobriety tests and the blood test was administered hours later they have NO proof of any kind of intoxication of any kind at the time of when the accident happens.
FST is how they prove intoxication it doesnt matter what your BAC is . .OOO and Failing FST will get you a DUI thay you have to fight to get out of.
Get a Lawyer and stop talking about details on this public forum.
This is all admissible in court.

Make better decisions before and while you drive. The biggest lesson you can learn from this is the the first rule of fight club.


Dont Talk about fight club.

Dont drive under any type of infuence , dont talk to the police about what happened ,rufuse FST and Breath test, dont talk to your friends about what happened .

You will incriminate yourself every time.

Definitely learned a lot and will do as advised!!

On another note, now I see how the air bag comes out of the steering wheel and what the inside of the headlight looks like...

Also, maybe you passed out from all those air fresheners hanging from your mirror

yeah it seemed kinda strange to me. they said its sent out somewhere else to get tested and not in the actual hospital where it was actually taken from.

from the crash it took one hour to end up in the hospital. once they took my x-ray and blood i was taken straight to jail.

As another member already mentioned, I will reiterate. Get a lawyer. never try to go it on your own, they will bury you.
If you need to borrow money to retain a lawyer, so be it. It is money well spent.

Very true.

OP mentioned his parents would help pay the remaining loan on the car. Skip that and let them help you with retaining a lawyer. Cars come and go.. your background history remains.

Yeah definitely getting a lawyer! Not going to try handling this on my own I’m mainly just trying to get the crash report and also figure out what my blood and alcohol level is. Big facts! Cars come and go! So I’m definitely trying to get this dui taken off

Simon, I enjoyed your posts and your time on the forum was cut too short by an unfortunate decision. Sometimes that's all it takes - one bad decision. I've made plenty in my lifetime and got lucky that most of them didn't ruin my life completely, etc. There's a lot of finger wagging in this thread and I doubt all of those fingers are attached to saints.

Enjoy the new car and fresh perspective on life. DEFINITELY lawyer up, assuming this is your first such incident it's worth trying to get it brushed away in lieu of hefty fines and/or other plea. First time offense that didn't seriously injure/kill anyone shouldn't ruin your life. Also, there's a difference between doing something stupid and something intentionally negligent. You clearly didn't set out that night to crash your car, so it's a shit happens situation. Beat yourself with a feather, welcome to being human.

Fwiw, the fact the blood test wasn't definitive the day of the incident and had to be 'sent away' leaves a lot of room for the lawyer to cast reasonable doubt. I'd expect, in the hands of a qualified defense lawyer, the charges to get reduced or tossed out altogether.

Dont get an r6! I mean do if you want but i recomend either a Triumph 675 Daytona or a (less$$ than you think) early ducati 748

Just saying because i have had both but the 3 cylinder and v twin both have better torque bands that let you have fun below 100mph

R6 is nice tho

I’m thinking of a cbr600rr. Not sure what year honestly. Going to be my first bike also lol. But I have a lot of people telling me if I get the 300 ima most likely want to sell and get the 600 pretty soon after
