My precious got rear ended....

Well 2 months and $15k later and she’s out of the shop. What a nightmare. Insurance delays, parts delays, oops something more needs to be fixed. Glad to have her back but devastated by this whole thing. I just bought her in Feb and paid $48k after negotiations (52k sticker) and owe $45k. Did a car fax and it’s worth $28k trade in value due to the serious accident cited. Not that I want to get rid of it, but man.... And now I’m worried about every stinking thing I see. It looks almost back to new. Except the steering wheel sits ever so slightly to the left, and I’ve got serious black gunk coming out of the exhaust. I’ve always had a little bit of carbon dust, but this is a lot of gunk, and only after a few trips since I got it back Friday.
That's nothing compared to that huge black smear over your license plate. What are you going to do about THAT!? (a little "black" humor;)).

That's good advice, to go back and make sure everything is fixed. And may you recover enough from the PTS of the accident to enjoy driving again!

Ha ha ha well you have to watch what you post out there...non identifiable information and all that!! Yes I wasn’t too rattled after the accident, except whenever there is a sudden slow down in traffic I’m anxiously checking my rearview!
 
I told them when this first happened I would want DV compensation on this and they told me it was impossible to prove unless I actually sold the car. Now that all is said and done and it shows it, I’m contacting MY agent tomorrow, and possibly a lawyer if I have to. The Carfax reflects a significantly lower value specifically because of the accident, and when I did some estimates of value without the damage, there’s about $5k difference.
So the other driver is at fault, right? Not sure where you live but most rear-ending accidents pits the fault at the driver who did the rear-ending. My brother got rear-ended three times in his old Optima in a no-fault state and never had to pay a dime for repairs. He even got compensated when the last rear-end accident totaled his car. It sucks to have your baby smashed up like that and even if everything "looks" okay, I understand the feeling of not feeling as confident in the car.

Heh! I check out my rearviews religiously/neurotically and I haven't even been rearended! So, I can imagine! I have composed six rules for defensive driving. Dropbox - DDD's rules for defensive driving.docx - Simplify your life And since getting the Stinger, I've moved "check your mirrors often" from number Six to number Four. :laugh: (they are listed in obvious or at least subjective order of priority)

Merlin, that's a great list. I've started to stay back a lot more -especially with Radar cruise- and usually, drive like a grandma since I don't need to race people on my commute. I've definitely become more aware of idiots on the road since I got my Stinger. ;)

Oh no, his insurance co paid for everything, towed my car 200 miles to my town, rental car for 2 months, and all the repairs. It was definitely his fault. I’m just concerned about the significant value decrease in the car now, and that everything is fixed properly. This was so upsetting, I love my stinger and had planned on keeping it PRISTINE, but it’s definitely severely blemished now.
 
A pristine repair with no frame damage, is as good as if nothing ever happened. Unless you sell, of course. But if you keep her, you'll never be able to tell, once everything is made right. Which I hope is what happens for you. :thumbup: The longer you keep her, the less impact the accident has on resale value. So, if/when eventually you do sell her, it will be miles/years that depreciates, and the accident will be a much smaller hit that you take.
 
No one has ever rear ended me but If someone does I think I could be charged with aggravated assault. Im glad you are good and get compensated for diminished value of the car, look up your local laws you can get compensated actually for your car decreased value I read it in the R8 forum when a member was rear ended as well and he got lots of money due to that.

That's good that they paid for it and I certainly feel your frustration. It sucks that the guy's shitbox damaged your pristine car but at least you weren't hurt and the car wasn't totaled. I'd definitely bring the car back to the shop and point out the steering wheel issue and any other issues with it. You deserve the get the car repaired back to as close to 100% as possible.

I know I shouldn’t fret about diminished value since yes, I do plan to drive her into the ground. But it’s just the principle of the whole thing!

Unfortunately it did have frame damage. A section of the rear frame was cut out and new piece was welded in. ☹️
 
Well, crap then. :thumbdown: But what I said still applies, just not as much; how much, "the future is unwritten".
 
Damn that sucks... I don’t know how realistic it is but I’d be pushing for it to be totaled if there is frame damage.

Why didn't you file a diminished value claim against him/his insurance? I was involved in a rear end accident a couple of years ago and got $3500 in diminished value for my truck and there wasn't even any frame damage. They actually replaced the whole bed of the truck plus new bumper and exhaust pipe that was damaged ($15k in repairs). What's more, I traded the truck in about 6 months after and the vehicle history report on it was clean.

As long as you haven't signed anything releasing them from damage to the car, you can still file a claim. Once they close out that case, you're SOL. My vehicle was about 2 years old at the time with about 70k miles. Initially, they had determined $0 in diminished value. Then they offered me $500... I found a company online that does diminished value reports. They either send someone out to take pictures or you can submit pictures yourself. These pics are of the current condition of your vehicle "after" repairs. The cost of the report is $295 but you can also claim that cost as well. They determines $5350 in (Inherent Diminished Value) plus the $295 for the cost of the report. His insurance sent their own investigator over to do an assessment and came up with $1250. Basically, we met in the middle for $3500. I had consulted a lawyer prior to all this and they basically stated it's very hard to prove diminished value unless you actually sell the car to prove your case. I chose to handle this portion on my own and it paid off. I did have a lawyer handle the "injury" portion of the case since my medical bills were out of control.

I have something to add that is positive: that "gunk" looks exactly like what I noticed this morning: and this is after I cleaned off my exhaust stubs yesterday afternoon: it was a cursory job, just to clean off the diffuser around the stubs, and the "ledge" between the left and right stubs. I used my new boar's hair brush on the dust; then sprayed ONR solution with my spray bottle, then wiped down the area to spiff it up. We drove last night. And this morning the very same colored "gunk" was along the bottom lip of each exhaust stub, and onto the diffuser below, almost identical to your pic. Spray bottle ONR water got rid of it instantly with a microfiber towel. So, not oil/turbo related at all. See if your mess cleans up with water too. :thumbup:
 
i won't settle down for nothing less that total compensation including total repair and diminished value reimbursement or receive status of totaled and whole reimbursement of the value of the car just prior the incident.
 
Following up on this mess...happy to report my car has been completely repaired and looks good. I hired an EXCELLENT appraiser to put together a diminished value claim. The report included me going to (2) dealerships and getting written offers--purchase from CarMax (which really was wholesale to the auctions because they don't sell cars that have been in accidents) and a trade in value from Lexus (I pretended I wanted to get a Lexus ES 350 F-sport). They were $24k and $30k respectively. He did other research, used a 17c formula that insurance companies use, and NADA values, and it was a very comprehensive 40 page report. His value came to about $27k with the accident, and $33k without accident, for a difference of $6,689. The insurance company flat out rejected the report as "speculation" and would not pay on it unless I SOLD the car and then came back to them. It is not the law that you have to sell your car in order to prove DV (couldn't afford to if I wanted to!), so I pushed them and said I would sue their insured if they did not pay this claim. They said they would do their own appraisal, and they came up with about $5500 in DV, and agreed to meet in the middle at about $6k. I got my $$, and so happy this is DONE! I hope more people for their sake find out about DV and if it's allowed in their state, and don't just take the hit on the value of their car lying down!
 
Wow what a nightmare. Glad it all "worked out" in the end but Im sure that was a lot of work and stress for you that was completely no fault of your own.

Fun little tid bit....Its been a little over a year since I got my stinger. First new car purchase of my life. Brought the car home that Saturday afternoon. Sunday morning, not even 24hrs later I am driving on the highway and a jackass in front of me driving like an ahole ends up rear ending a car stopped on the highway directly in front of me. I emergency braked and was able to stop in time but then I am sitting there parked on the interstate behind this crash and just start to hear brakes lighting up, tires squealing, see people next to me getting rear ended and a car rapidly approaching from behind. I felt so damn helpless and basically just braced for impact. Somehow though everyone behind me was able to stop and I came away unscathed. Well, basically had to change my pants but other than that all OK. 25 minutes later I arrived where I was going and my heart was still racing and hands shaking.

Reading your post here brought back that terrible memory and really reminds my how lucky I was. I can't even fathom having to go through all this, especially not even 24hrs into owning the vehicle. Like a poster above, not only would my Stinger have been damaged but I likely would've ended up with some sort of assault charges!! Anyway, good luck with the car going forward. Be safe out there people!
