Victim of an insurance scam, had some slam the brakes on infront of me had no time to stop completely and the dam insurance wrote it off
Seriously?! Your response seems to disagree with the write off. That is a first (on here anyway). What kind of damage did you sustain?
 
All I could see was passenger fender, hood, front bumper and headlight. When I went to get my plates from it the only other damage was the aluminum brace on the passenger side. There were worse off cars in the shop being repaired so I was confused as to why they wrote mine off.

You could take the money for a write off and keep the car. Why didn't you insist on that? Get it fixed on your own volition. The insurance company wouldn't have to be involved after that. That's how I've done it several times in the past: got the car repaired to a drivable level and put the payout in the bank. Maybe it's different with a crashed brand new car?
